1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and LomloeHub ("Company," "we," "us," or "our"). By accessing or using LomloeHub (the "Service"), you agree to be bound by these Terms. If you do not agree to any part of these Terms, you may not use the Service.

These Terms apply to all users of LomloeHub, including teachers, educational administrators, students, families, and any other individuals or organizations accessing our platform.

2. Service Description

LomloeHub is an educational technology platform designed to support LOMLOE-aligned teaching and learning. The Service includes:

Lesson plan generation tools with LOMLOE competency alignment
School calendar management and scheduling features
Student progress tracking and performance analytics
Resource sharing and collaboration tools
Assessment and evaluation features
Additional features and updates as we develop them

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.

3. User Eligibility & Accounts

3.1 Age Requirements

You must be at least 13 years old to create an account. For users under 14 years old, parental or guardian consent is required. Educational institutions may create accounts for students under 13 with appropriate institutional authorization.

3.2 Account Creation

You agree to provide accurate, current, and complete information during account registration. You are responsible for maintaining the confidentiality of your password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

3.3 Account Responsibility

You are solely responsible for all activity on your account. We are not liable for any loss or damage resulting from unauthorized access to your account. If you believe your account has been compromised, contact us immediately at [email protected].

4. Acceptable Use Policy

You agree not to use LomloeHub for any unlawful, harmful, or inappropriate purposes. Specifically, you agree NOT to:

Violate any applicable laws, regulations, or institutional policies
Harass, threaten, defame, or abuse other users
Create or share content that is sexually explicit, violent, or discriminatory
Attempt to gain unauthorized access to the Service or other users' accounts
Upload malware, viruses, or other harmful code
Spam, phish, or engage in fraudulent activities
Infringe upon intellectual property rights of others
Collect or use personal data of other users without consent
Reverse engineer, decompile, or attempt to discover source code
Use the Service for commercial purposes without authorization

Violations of this policy may result in account suspension or termination without refund.

5. Intellectual Property Rights

5.1 LomloeHub Content

All content provided by LomloeHub, including text, graphics, logos, images, templates, and software, is the exclusive property of LomloeHub or its licensors. You are granted a limited, non-exclusive, non-transferable license to use this content solely for educational purposes within your institution.

5.2 User-Generated Content

You retain ownership of all content you create and upload to LomloeHub (lesson plans, materials, assessments, etc.). By uploading content, you grant LomloeHub a worldwide, royalty-free license to use, store, and display your content for the purpose of providing the Service.

You represent and warrant that you own or have the necessary rights to all content you upload, and that your content does not infringe upon any third-party rights.

5.3 Attribution

If you share resources created by others through LomloeHub, you must provide appropriate attribution and respect the original creator's intellectual property rights.

6. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, LOMLOE HUB SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS INTERRUPTION, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO LOMLOE HUB IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR $100 IF YOU HAVE NOT PAID ANYTHING.

7. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

LOMLOE HUB DOES NOT WARRANT THAT:

The Service will be uninterrupted or error-free
Any defects will be corrected
The Service is free from viruses or harmful components
Generated content will meet all educational standards or requirements

8. Indemnification

You agree to indemnify, defend, and hold harmless LomloeHub and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including attorney's fees) arising from or related to your use of the Service, violation of these Terms, or infringement of any third-party rights.

9. Termination

We may terminate or suspend your account and access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service ceases immediately.

You may terminate your account at any time by contacting us at [email protected]. Upon termination, we will delete your account data within 30 days, except as required by law.

10. Subscription & Payment Terms

10.1 Pricing

Pricing for LomloeHub subscriptions is displayed on our website and may change with 30 days' notice. Changes to pricing will not affect your current subscription until the renewal date.

10.2 Billing

Subscriptions are billed automatically on a recurring basis. You authorize us to charge your payment method on file. If payment fails, we may suspend your access until payment is received.

10.3 Refunds

Subscription fees are non-refundable except as required by law. You may cancel your subscription at any time, and your access will continue until the end of the current billing period.

11. Modifications to Terms

We may modify these Terms at any time. Significant changes will be communicated via email or prominent notice on our platform. Your continued use of the Service after modifications constitutes acceptance of the updated Terms.

12. Governing Law & Dispute Resolution

These Terms are governed by the laws of Catalonia and Spain, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved through:

Good faith negotiation between the parties
Mediation through a mutually agreed mediator
Binding arbitration under Spanish arbitration law
Jurisdiction of the courts of Barcelona, Catalonia

14. Severability

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and LomloeHub regarding the Service and supersede all prior agreements and understandings.
